From modest beginnings, we have steadily grown into a well-established practice advising a diverse clientele, ranging from private individuals and family businesses to large domestic and multinational corporations.

Drawing on decades of experience in Mauritian law and procedure, we are recognised for delivering clear, practical and solution-oriented legal advice. Some notable matters on which the lawyers of the Étude have been involved include:

  1. Representing an established construction company in an application to annul an international arbitration award.
  2. Acting for a contractor in an arbitration claim in excess of MUR 150 million against the employer under FIDIC conditions of contract.  
  3. Assisting a global business company in an International Chamber of Commerce (ICC) arbitration commenced to determine whether its board of directors had been legally constituted.
  4. Advising a local bank on the recovery of debts via legal action such as bankruptcy and seizure proceedings, providing legal opinions on company and banking laws, court process, employment-related disputes, and representing the bank before different fora.
  5. Obtaining the discharge of attachment orders sought by the then Independent Commission Against Corruption (ICAC) against company assets, which comprised a substantial number of immovable properties in Mauritius. 
  6. Representing the current Prime Minister of Mauritius in court proceedings to successfully obtain the discharge of an attachment order issued against the bank accounts of his party by the regulator.
  7. Initiating proceedings on behalf of a shareholder of a major real estate corporation in Mauritius after a dispute between the partners arose to compel the acquisition of his shares.
  8. Assisting a shareholder of a global business company in liquidation to recoup losses caused by the actions of the directors at the time.
  9. Advising local companies and overseas conglomerates on public procurement and bidding exercises in Mauritius, including representing them in proceedings to challenge awards by the public bodies.
  10. Advising receiver-managers, administrators and liquidators on their appointment, duties and on the distribution of sale proceeds, and assisting with litigation under the Insolvency Act.​
  11. Advising on a commercial dispute between a local pharmaceutical company and an international courier enterprise.
  12. Drafting and reviewing real estate promotion and joint venture agreements for real estate developers.
  13. Advising on agreements to assign claims worth USD 50 million.
  14. ​Assisting partners of an entity subject to a Deed of Company Arrangement in litigation exceeding USD 25 million against the Deed Administrator and creditors.
  15. Challenging the constitutionality of legislative amendments allowing law enforcement officials to access prescription records kept by pharmacies, and of certain actions of the then Speaker of the Mauritius National Assembly.

Hiren Jankee

Hiren is a Senior Attorney, practising at a high level for more than 40 years. During his career, he has appeared before all the courts and tribunals of the island in relation to countless litigation matters. He is well versed in various aspects of law. He works regularly in alliance with several leading management companies in connection to corporate and commercial law both in the local context and in the global-business context. Hiren also acts as legal adviser to parastatal bodies such as the State Investment Corporation Ltd. As legal adviser to banking institutions, Hiren acted in one of the largest insolvency cases in the history of Mauritius, with a value of over MUR 4 billion, in which a challenge to his client’s appointment of a receiver-manager under a charge instrument was successfully resisted. Hiren has instructed King’s Counsel before the Supreme Court of Mauritius and before the Judicial Committee of the Privy Council in arbitration-related and election petition cases. He was previously the Chairman of SBI (Mauritius) Ltd and of the Gambling Regulatory Authority.

Shameek Jankee

Shameek is mostly involved in commercial advisory and litigation. He regularly drafts pleadings in requests for injunctive relief, claims for damages and severance allowance, and applications under international arbitration legislation and the Companies Act. He habitually appears before the Bankruptcy and Commercial Divisions of the Supreme Court. Shameek regularly advises conglomerates, Top 100 Companies and financial institutions on myriad issues including legal risk mitigation strategies. Shameek previously practised as an Attorney at Dentons Mauritius LLP. He read law at the University of Warwick, UK, and holds Master’s degrees from the London School of Economics and Political Science, UK, and from Université Paris 2 Panthéon-Assas, France.
